Terms of Service for Summer Ledger

Welcome to Summer Ledger ("the Service", "we", "us", "our"). By creating an account and using our web application, you are agreeing to be bound by the following terms and conditions ("Terms of Service"). Please read them carefully.

1. Account Registration and Security

  • Accurate Information: You agree to provide accurate and complete information when you create your account and to keep this information up-to-date.
  • Account Credentials: You are solely responsible for maintaining the confidentiality of your account credentials, including your password, your separate Gallery Code, and any passkeys you register. You are responsible for all activities that occur under your account. You agree not to share your password or Gallery Code with others.
  • Security: We implement security measures such as password hashing and rate limiting to protect your account. However, we cannot guarantee absolute security. You must notify us immediately of any unauthorized use of your account.

2. User Content

  • Ownership: You retain full ownership of all the content you create and upload to the Service, including notes, partner details, photos, videos, and any other data ("User Content").
  • License to Us: By using the Service, you grant Summer Ledger a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (e.g., for display purposes), and process your User Content solely for the purpose of operating, providing, and improving the Service for you. This includes displaying your data on your dashboard, processing it through AI features you choose to use, and storing your media files.
  • Responsibility: You are solely responsible for your User Content and the consequences of posting or publishing it. You affirm that you have the necessary rights to the content you upload and that it does not violate any laws or third-party rights.
  • Prohibited Content: You agree not to upload any content that is illegal, defamatory, hateful, or infringing on intellectual property rights. We reserve the right, but not the obligation, to remove any User Content and terminate accounts that violate these Terms.

3. Service Usage and Features

  • Acceptable Use: You agree not to misuse the Service. This includes, but is not limited to, attempting to gain unauthorized access to our systems, interfering with the Service's operation, or using the Service for any illegal purpose.
  • AI-Powered Features: The Service utilizes third-party AI models (provided by Cloudflare) for features like voice memo transcription and encounter summarization. By using these features, you consent to your User Content (such as audio or notes) being sent to these third-party services for processing. While these services are engaged under strict privacy terms, we cannot guarantee the accuracy, availability, or appropriateness of AI-generated content.
  • Storage Quotas: The Service provides a specific amount of storage for your media files. You will be notified of these limits within the application. We reserve the right to restrict uploads if you exceed your quota.
  • Data Backup and Restore: The Service provides tools to back up and restore your data. You are encouraged to create regular backups. We are not liable for any loss or corruption of your User Content.

4. Termination

  • By You: You may terminate this agreement at any time by using the "Delete Account" feature in your account settings. This action is irreversible and will permanently delete all of your User Content from our databases and storage.
  • By Us: We may suspend or terminate your account at our discretion if you violate these Terms of Service.

5. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, SUMMER LEDGER AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN.

6. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes. By continuing to use the Service after changes become effective, you agree to be bound by the revised terms.

7. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which the company is based, without regard to its conflict of law provisions.
